نقش بازیگران غیردولتی در توسعه و بازنگری قواعد حقوق بین‌الملل

حقوق بین‌الملل نظامی است که بر پایه اراده دولتها شکل‌گرفته و دولتها کماکان بازیگر اصلی این نظام قلمداد می‌شوند. هرچند در قرن بیستم موجودیت‌ها و نهاد‌های مختلفی در نظام حقوق بین‌الملل سر برآورده اند، با این وجود هنوز نتوانسته اند به جایگاهی همچون جایگاه دولت دست یابند؛ بنابراین دولتها ستون اصلی جامعه بین‌المللی را تشکیل می‌دهند؛ آن‌ها از اهلیت حقوقی کامل، یعنی توانایی در اختیار گرفتن حقوق، اختیارات و تعهدات گوناگون برخوردارند. این پژوهش به روش رویکردی توصیفی ـ تحلیلی و با هدف بررسی نقش بازیگران غیردولتی در توسعه و بازنگری قواعد و مقررات حقوق بین‌الملل انجام شد. نتایج نشان داد که حقوق بین‌الملل علی رغم مشارکت فعال برخی از بازیگران غیردولتی در شکل‌گیری و اجرای قواعد بین‌المللی، شخصیت حقوقی بین‌المللی در حد تابعان این حقوق را برای بازیگران غیردولتی شناسایی نکرده است.
