    <Abstract>&lt;p&gt;Insult is one of the moral abominations that, by destroying individuals’ dignity and degrading their character, clearly exemplifies the violation of others’ rights. In recent years, the issue of insulting the sanctities of Islam—including insulting the Prophet Muhammad (PBUH), the Holy Quran, and others—has increasingly surfaced, thereby making such insults and similar crimes a subject of legal and societal concern. This article, entitled “Defamation (Qazf) from the Perspective of Jurisprudence and Law,” examines this destructive vice along with its motivations and adverse effects on both individual and social life, based on jurisprudential and legal sources. It ultimately finds that insults are among the crimes directly connected to the dignity and honor of individuals, and their occurrence results in the violation of these sacred attributes. Consequently, in the Islamic criminal system and the pertinent legal framework, both fixed (hud) and discretionary (ta'zir) punishments are prescribed according to the circumstances of the offense. In this paper, we specifically discuss an offense—defamation (qazf)—that is subject to a fixed punishment.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;توهین یکی از زشتی‌های اخلاقی است که به جهت از بین بردن آبروی افراد و تحقیر شخصیت ایشان، از مصادیق بارز نادیده گرفتن حق‌الناس محسوب می‌شود. از آنجا که در سال‌های اخیر مسأله توهین به مقدسات اسلام – از جمله توهین به پیامبر اکرم (ص) و قرآن کریم و ... – ظهور و بروز بیشتری پیدا کرده است، در نتیجه موجب موضوعیت یافتن توهین و جرائمی نظیر آن در جوامع بشری شده است. مقاله پیش‌رو با عنوان «قذف از دیدگاه فقه و حقوق» به بررسی این بیماری مهلک و انگیزه‌ها و آثار سوء آن در زندگی فردی و اجتماعی افراد با استناد به مآخذ فقهی و حقوقی می‌پردازد و نهایتاً درمی‌یابد که توهین از جمله جرائمی است که ارتباط مستقیم با حیثیت و شرافت اشخاص دارد و تحقق آن موجبات هتک حرمت افراد را فراهم می‌سازد؛ بنابراین در نظام کیفری اسلام و حقوق موضوعه، مجازات حد وتعزیر به تناسب شرایط ایجاد جرم تعیین شده است. در این مقاله به بحث درباره توهینی خواهیم پرداخت که مجازات آن از نوع حدود می‌باشد؛ از توهینی که مجازات آن از نوع حد است، می‌توان به قذف اشاره کرد.&lt;/p&gt;</OtherAbstract>
