    <Abstract>&lt;p&gt;One of the major risks in international trade involves concerns about the potential non-payment of the transaction price by the buyer to the seller, and simultaneously, the non-compliance of the goods sent by the seller with the agreed-upon contract. The function of bank guarantees and letters of credit is to resolve such issues in international trade. Accordingly, the purpose of the present article is to examine letters of credit and bank guarantees in international trade payments from the perspective of Islamic jurisprudence (fiqh) and Iranian law. This article is descriptive-analytical. The materials and data are qualitative, and the method of data collection is through note-taking. From a jurisprudential and legal standpoint, bank guarantees do not fully align with the recognized contracts in Islamic jurisprudence and Iranian law. In fact, contracts, especially the contract of guarantee (ḍamān), are not entirely suitable frameworks for various types of bank guarantees, as they do not fully encompass the conditions and obligations of the parties involved in bank guarantees. As for letters of credit, it should be noted that the legal nature of a letter of credit is a newly established legal entity that cannot be analyzed within previous legal frameworks. International bank guarantees differ from letters of credit due to their distinct purposes: in letters of credit, the function is payment, while in guarantees, the function is assurance, and the operational cycle differs accordingly. The bank's obligation in letters of credit is conditional upon the presentation of documents, whereas in guarantees, it is generally unconditional.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;یکی از مهمترین ریسک‌های عمده در تجارت بین‌الملل به نگرانی در خصوص احتمال عدم پرداخت وجه و ثمن معامله از سوی خریدار به فروشنده و در عین حال تطابق نداشتن کالای ارسال شده از سوی فروشنده مطابق قرارداد منعقد شده است. کارکرد ضمانت‌نامه‌های بانکی و اعتبارات اسنادی رفع مشکلات این چنینی در تجارت بین‌المل است. بر همین اساس هدف مقاله حاضر بررسی اعتبارات اسنادی و ضمانت‌نامه‌های بانکی در پرداخت‌های تجارت بین‌الملل از منظر فقه و حقوق ایران است. مقاله حاضر توصیفی تحلیلی است. مواد و داده‌ها نیز کیفی است و از فیش‌برداری در گردآوری مطالب و داده‌ها استفاده‌شده است. از منظر فقهی و حقوقی ضمانت‌نامه‌های بانکی با عقود شناخته شده در فقه و حقوق ایران تطابق کامل ندارد. در واقع، ایقاعات و عقدها به ویژه عقد ضمان، ظروف و قالب‌های برازنده‌ای برای انواع گوناگون ضمانتنامه‌های بانكی نیستند زیرا شرایط و تعهدات طرفین در ضمانت نامه‌های بانكی را کامل شامل نمی‌شوند. در خصوص اعتبارات اسنادی نیز باید گفت که ماهیت حقوقی اعتبار اسنادی، یک تاسیس حقوقی نو ظهور است که در قالب نهادهای پیشین قابل تحلیل نیست. ضمانت‌نامه‌های بانکی بین‌المللی نسبت به اعتبارات اسنادی با توجه به تفاوت آن‌ها از نظر هدف که در اعتبارات اسنادی وظیفه پرداخت است و در ضمانت نامه‌ها وظیفه تضمین و چرخش عملیات متفاوت از یکدیگر می‌باشد. وظیفه بانک در اعتبارات اسنادی مشروط به ارائه اسناد است ولی در ضمانت نامه معمولا بدون شرط است.&lt;/p&gt;</OtherAbstract>
