However, the mechanism by which this jury is selected and its orientation can influence societal perception, potentially either supporting or undermining public freedoms. In Iran, despite the longstanding presence of the jury institution, it has yet to achieve an appropriate standing, with the roots of this issue lying in the selection process of its members and the lack of clarity regarding its jurisprudential foundations. The structure and function of the jury are based on the popular election of members, the judge's attention to their decision, the absence of judicial expertise, and the lack of intervention by jury members in the judgment itself. The jurisprudential perspective on this matter has not yet been adequately defined within Iranian law. Therefore, given the sensitivity and importance of public freedoms, the establishment of an independent jury in political and press trials could at least partially guarantee this aspect of freedoms in Iran.</p> <p>تشکیل هیات منصفه در نظام قضایی بخصوص در رسیدگی به جرائم سیاسی و مطبوعاتی می‌تواند تضمین کننده آزادی‌های عمومی باشد. اما اینکه این هیات منصفه با چه سازوکاری انتخاب و چه سمت و سویی دارد موضوعی است که می‌تواند در نگاه جامعه، تامین کننده آزادی‌های عمومی باشد و یا ناقض این آزادی‌ها برشمرده شود. در ایران اما نهاد هیات منصفه علیرغم قدمتی که دارد هنوز از جایگاه مناسبی برخوردار نیست و ریشه این مهم را می‌توان در نحوه انتخاب اعضاء و همچنین روشن نشدن مبانی فقهی آن دانست. ساختار و عملکرد هیات منصفه بر اساس انتخاب مردمی اعضا، توجه قاضی به رای آن‌ها، عدم دارا بودن تخصص قضایی و عدم دخالت اعضای این هیات در قضاوت بنا نهاده شده است که دیدگاه فقهی برای این مهم در حقوق ایران هنوز به درستی تبیین نشده است. بر همین اساس و با توجه به حساسیت و اهمیت آزادی‌های عمومی، تشکیل هیات منصفه مستقل در محاکمات سیاسی و مطبوعاتی می‌تواند حداقل تامین کننده این بخش از آزادی‌ها در ایران باشد.</p> https://csjlp.org/index.php/csjlp/article/download/148/108
