Journal Article 2024 12 06 <p>The right to education for children has been emphasized in international documents. However, violations and challenges surrounding this right are significant issues that need to be elucidated and analyzed. Therefore, the aim of the present article is to examine the question: What are the violations and challenges to the right to education for children in light of the requirements of international documents? This article is descriptive-analytical and uses a library research method to address the stated question. Discrimination, violation of the right to awareness, violation of the right to development, violation of educational equality, and violations of the human rights foundations of the right to education are instances of the violation of children’s right to education in light of the requirements of international documents. Structural shortcomings in the education system, lack of attention to and allocation of sufficient budgets and resources for education, failure to refine educational laws and higher-level documents in the field of the country’s comprehensive education system, lack of cooperation, coordination, and absence of an executive agreement between the Ministry of Education and supportive organizations to meet international requirements are challenges facing the right to education for children in Iran. Strategies for ensuring the right to education for children in Iran, in alignment with international documents, to overcome the harms and challenges of international requirements, include the refinement of higher-level documents and educational laws, structural reforms in the education system, revisions to the national budget law in terms of prioritization, redefining educational concepts in relation to indigenous, religious, cultural, and human rights frameworks within the framework of the Organization of Islamic Cooperation, and drafting independent documents in this regard.</p> <p>حق بر آموزش کودکان در اسناد بین‌‌المللی مورد تاکید قرار گرفته است. اما موارد نقض و چالش‌های فراروی این حق از موضوعات مهمی است که لازم است تبیین و تحلیل شود. بر همین اساس هدف مقاله حاضر بررسی این سوال است که موارد نقض و چالش‌های حق بر آموزش کودکان در پرتو الزامات اسناد بین‌‌المللی کدام است؟ این مقاله توصیفی تحلیلی است و با استفاده از روش کتابخانه‌ای به بررسی سوال مورد اشاره پرداخته است. تبعیض، نقض حق بر آگاهی، نقض حق بر توسعه، نقض برابری آموزشی، نقض مبانی حقوق بشری حق بر آموزش موارد نقض حق بر آموزش کودکان در پرتو الزامات اسناد بین‌‌المللی است. عدم اصلاح ساختاری در نظام آموزش و پرورش، عدم توجه و تامین بودجه و اختصاص اعتبارات مکفی برای آموزش و پرورش، عدم تنقیح قوانین آموزش و پرورش و اسناد بالادستی در حوزه نظام جامع آموزش کشور، عدم همکاری و هماهنگی و عدم وجود توافق نامه اجرایی میان سازمان آموزش و پرورش و سازمان‌های حمایتی برای تحقق الزامات بین المللی چالش‌های فراروی حق بر آموزش به کودکان در ایران است. راهبردهای حق بر آموزش به کودکان در ایران در تطبیق با اسناد بین المللی برای غلبه بر آسیب‌ها و چالش‌های الزامات بین المللی تنقیح اسناد بالادستی و قوانین آموزش و پرورش، اصلاح ساختاری آموزش و پرورش، اصلاح قانون بودجه سالیانه کشور در اولویت‌بندی، اصلاح تعریف صحیح از مفاهیم آموزشی بومی، دینی، فرهنگی و حقوق بشری در چارچوب سازمان کنفرانس اسلامی و تدوین اسناد مستقل در این زمینه است.</p> https://csjlp.org/index.php/csjlp/article/download/170/219
