Given the profound influence of Islam on the political and legal frameworks of both countries, their constitutions contain provisions that directly and indirectly define and limit the rights of religious minorities. The paper explores the similarities and differences in the general principles, rights, and freedoms of religious minorities in these two nations, and examines the common and unique challenges and obstacles in the implementation of these rights. The findings indicate that both countries face similar challenges, such as the influence of extremist religious groups and the weakness of judicial and executive institutions in protecting minority rights, although differences exist in their approaches to addressing these issues. Finally, the article offers recommendations for improving the status of religious minority rights in both countries.</p> <p>این مقاله به بررسی تطبیقی حقوق اقلیت‌های مذهبی در قوانین اساسی افغانستان و پاکستان می‌پردازد. با توجه به تأثیرات عمیق اسلام بر ساختارهای سیاسی و حقوقی این دو کشور، قوانین اساسی آن‌ها شامل اصولی هستند که به‌طور مستقیم و غیرمستقیم حقوق اقلیت‌های مذهبی را تعیین و محدود می‌کنند. این مقاله به تحلیل شباهت‌ها و تفاوت‌های موجود در اصول کلی، حقوق و آزادی‌های اقلیت‌های مذهبی در این دو کشور پرداخته و چالش‌ها و موانع مشترک و متفاوت در اجرای این حقوق را بررسی می‌کند. نتایج نشان می‌دهد که هر دو کشور با چالش‌های مشابهی مانند تأثیر گروه‌های افراطی مذهبی و ضعف نهادهای قضایی و اجرایی در حمایت از حقوق اقلیت‌ها مواجه هستند، اما تفاوت‌هایی نیز در نحوه برخورد با این چالش‌ها وجود دارد. در نهایت، این مقاله پیشنهاداتی برای بهبود وضعیت حقوق اقلیت‌های مذهبی در هر دو کشور ارائه می‌دهد.</p> Religious minority rights Constitution of Afghanistan Constitution of Pakistan Islam Human rights Implementation challenges حقوق اقلیت‌های مذهبی قانون اساسی افغانستان قانون اساسی پاکستان اسلام حقوق بشر چالش‌های اجرایی https://csjlp.org/index.php/csjlp/article/download/25/8
