Journal Article 2024 09 07 <p>Crimes against chastity and public morality represent a serious social and cultural challenge in Iran, particularly with the rise of modern technologies and the expansion of cyberspace, leading to an increase in such offenses. This article examines the current legal and executive measures for preventing these crimes and analyzes the existing weaknesses in the laws and enforcement mechanisms. It focuses on relevant laws such as the Islamic Penal Code and the Cyber Crimes Law, while assessing the challenges in coordination between judicial and executive institutions. Furthermore, the impact of cyberspace on the proliferation of these offenses and the difficulties in controlling and monitoring digital platforms are critically reviewed. Additionally, the study highlights the role of culture and public education in preventing crimes against public morality, proposing cultural and social solutions to raise public awareness and strengthen the role of families and schools in promoting ethical and religious values. The article also emphasizes the importance of media in fostering public morality and preventing the spread of moral corruption. Finally, recommendations are provided to strengthen legal frameworks and improve coordination between executive and cultural institutions to more effectively prevent such crimes and establish a society with sustained public chastity and morality.</p> <p>جرائم علیه عفت و اخلاق عمومی یکی از چالش‌های جدی اجتماعی و فرهنگی در ایران محسوب می‌شود که با ظهور فناوری‌های نوین و تغییرات گسترده در فضای مجازی، روند افزایشی پیدا کرده است. این مقاله به بررسی اقدامات قانونی و اجرایی کنونی برای پیشگیری از این جرائم می‌پردازد و نقاط ضعف موجود در قوانین و نهادهای اجرایی را تحلیل می‌کند. در این راستا، به بررسی قوانین مرتبط با جرائم منافی عفت، از جمله قانون مجازات اسلامی و قانون جرائم رایانه‌ای پرداخته و مشکلات موجود در هماهنگی میان نهادهای اجرایی و قضایی بررسی می‌شود. همچنین، تأثیر فضای مجازی بر گسترش این جرائم و چالش‌های موجود در کنترل و نظارت بر این فضا مورد ارزیابی قرار می‌گیرد. از سوی دیگر، این پژوهش نقش فرهنگ و آموزش عمومی در پیشگیری از جرائم منافی عفت را مورد تأکید قرار داده و راهکارهای فرهنگی و اجتماعی برای ارتقای سطح آگاهی عمومی و تقویت نقش خانواده و مدارس در ترویج ارزش‌های اخلاقی و دینی را ارائه می‌دهد. همچنین، بر اهمیت نقش رسانه‌ها در ترویج اخلاق عمومی و جلوگیری از اشاعه فساد اخلاقی تأکید می‌شود. در نهایت، پیشنهاداتی برای تقویت چارچوب‌های قانونی و افزایش هماهنگی میان نهادهای اجرایی و فرهنگی مطرح شده است تا با بهره‌گیری از این راهکارها بتوان به‌طور مؤثر از وقوع این جرائم جلوگیری کرد و جامعه‌ای با عفت عمومی و اخلاقی پایدارتر ایجاد کرد.</p> https://csjlp.org/index.php/csjlp/article/download/250/129
