The study explores the similarities and differences between these two countries in their use of legal systems to address social challenges, economic inequalities, and the strengthening of democratic institutions and human rights. Both Algeria and Kenya, after gaining independence from colonial legal systems primarily designed to benefit colonial powers, sought to establish indigenous and independent legal frameworks. Along this path, new laws were enacted in various areas such as land reform, women's and minority rights, and anti-corruption measures. The comparative study reveals that despite historical and social similarities, cultural and legal differences have led to different outcomes in the social transformation processes of these two nations. Utilizing comparative methods and theoretical analyses, this article delves into the impacts of law on social transformations in Algeria and Kenya and offers recommendations for policymakers and researchers in this field.</p> <p>این مقاله به بررسی نقش حقوق در فرآیندهای تحول اجتماعی در دو کشور پسااستعماری الجزایر و کنیا می‌پردازد. در این مطالعه، شباهت‌ها و تفاوت‌های میان این دو کشور در استفاده از نظام‌های حقوقی برای مقابله با چالش‌های اجتماعی، نابرابری‌های اقتصادی و تقویت نهادهای دموکراتیک و حقوق بشر مورد بررسی قرار می‌گیرد. الجزایر و کنیا هر دو پس از استقلال از نظام‌های حقوقی استعماری که عمدتاً به نفع قدرت‌های استعماری طراحی شده بودند، تلاش کردند تا نظام‌های حقوقی بومی و مستقل ایجاد کنند. در این مسیر، قوانین جدیدی در زمینه‌های مختلف مانند اصلاحات ارضی، حقوق زنان و اقلیت‌ها، و مبارزه با فساد تصویب شد. مطالعه تطبیقی نشان می‌دهد که با وجود شباهت‌های تاریخی و اجتماعی، تفاوت‌های فرهنگی و حقوقی منجر به نتایج متفاوتی در فرآیندهای تحول اجتماعی در این دو کشور شده است. این مقاله با استفاده از روش‌های تطبیقی و تحلیل‌های نظری، به بررسی دقیق‌تر تأثیرات حقوق بر تحولات اجتماعی در الجزایر و کنیا پرداخته و پیشنهاداتی برای سیاست‌گذاران و پژوهشگران در این حوزه ارائه می‌دهد.</p> https://csjlp.org/index.php/csjlp/article/download/32/15
