    <Abstract>&lt;p&gt;Telemedicine refers to the use of information and communication technologies to provide healthcare, services, and patient support when a geographical distance exists between the patient and the medical team. Telemedicine differs from traditional medicine (i.e., medicine delivered through conventional societal means). Given its application in treatment as well as in other areas such as medical education and consultation across various regions within a country and sometimes beyond national borders, it clearly necessitates the establishment of an appropriate and well-drafted legal framework that can address its legal gaps both on national and transnational levels (e.g., conflict of jurisdiction issues). After conducting a thorough review, it was found that there is no comprehensive and specialized legislation in Iran that specifically addresses the legal challenges in this field. Consequently, existing laws are utilized, along with analogical reasoning and recommendations, to address related legal issues. When medical services are provided through conventional means, identifying the legal relationships between patients and service providers is relatively straightforward. However, in telemedicine services, we often observe the direct or indirect involvement of at least one physician who is not a member of the treatment center and may even be located in a remote region or a different country. Does a relationship—contractual or otherwise—exist between the patient and the aforementioned physician? Since the physician-patient relationship is inherently contractual in nature and is defined as a treatment contract, various legal principles can be applied in Iran to resolve jurisdictional conflicts and determine the applicable law. These include the law of the place where the contract was concluded, the law of the parties' shared domicile, the law of the place of performance of the obligation, the law of the parties' nationality, or the law mutually agreed upon by the parties.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;پزشکی از راه دور یا دورپزشکی به کاربرد فناوری اطلاعات و ارتباطات، برای فراهم‌آوردن مراقبت بهداشتی، خدمات و حمایت از بیمار در زمانی که فاصله جغرافیایی بین بیمار و تیم درمان‌، وجود دارد، گفته می‌شود. پزشکی از راه دور با طب سنتی (پزشکی از طریق عادی و معمول جامعه) تفاوت دارد. با توجه کاربرد آن برای درمان و سایر مسائل مثل آموزش و مشاوره پزشکی بین نقاط مختلف یک کشور و گاه فراتر از یک کشور، به وضوح نشان می‌دهد و می‌طلبد که یک قانون شایسته، تنظیم شده و خلأهای حقوقی آن را در سطح ملی و فراملی (مثل بحث حل تعارض در صلاحیت‌ها) حل کند. پس از بررسی‌های به عمل‌آمده متوجه شدیم، که در ایران،  هیچ قانون مدونی که به صورت تخصصی به حل چالش‌های حقوقی در این زمینه بپردازد نداریم و با استفاده از سایر قوانین موجود و قیاس و دادن پیشنهاد، به حل مسائل می‌پردازند. هنگامی كه خدمات پزشکی به روش عادی ارائه می‌شود، تشخیص روابط موجود میان بیماران و ارائه‌كنندگان خدمات آسان است. لیکن در ارائة خدمات به صورت پزشکی از راه دور، دخالت مستقیم یا غیرمستقیم حداقل یک پزشک كه نه تنها از اعضاء مركز درمانی نیست، بلکه در منطقه‌ای دوردست و گاه در كشوری دیگر حضور دارد، را می‌بینیم. آیا میان بیمار و پزشک مذكور رابطه‌ای اعم از قراردادی یا غیر قراردادی وجود دارد؟ از آنجایی که رابطه پزشک و بیمار، یک رابطه قراردادی است، تحت عنوان قرارداد درمان؛ برای حل تعارض مسائل مربوط به صلاحیت در ایران و قانون حاکم بر آن می‌توان، قانون محل انعقاد قرارداد، قانون اقامتگاه مشترک طرفین، قانون محل اجرای تعهد، قانون دولت متبوع طرفین یا قانون مورد تراضی طرفین را بر آن حاکم دانست.&lt;/p&gt;</OtherAbstract>
