It begins by analyzing the concepts and principles of ownership in Islamic jurisprudence and Ayatollah Boroujerdi's viewpoints. Subsequently, the foundations of property rights in the Iranian Civil Code are examined, along with different types of ownership, including individual and joint ownership. The study then compares the principles of ownership in Ayatollah Boroujerdi's theory with those in the Iranian Civil Code, discussing their similarities and differences. The findings indicate that Ayatollah Boroujerdi's theory, with its emphasis on social justice and the responsibilities of the owner, could serve as a valuable foundation for revising and improving property laws in Iran. Finally, the article offers recommendations for enhancing property laws based on this theory and suggests avenues for further research.</p> <p>این مقاله به بررسی تطبیقی نظریه مالکیت آیت‌الله سید حسین طباطبایی بروجردی، یکی از برجسته‌ترین مراجع تقلید شیعه در قرن اخیر، با حقوق مالکیت در قانون مدنی ایران می‌پردازد. ابتدا، مفاهیم و اصول مالکیت در فقه اسلامی و دیدگاه‌های آیت‌الله بروجردی مورد تحلیل قرار می‌گیرد. سپس، مبانی حقوق مالکیت در قانون مدنی ایران مورد بررسی قرار گرفته و اقسام مختلف مالکیت، از جمله مالکیت فردی و اشتراکی، تحلیل می‌شود. در ادامه، مقایسه‌ای میان مبانی و اصول مالکیت در نظریه آیت‌الله بروجردی و قانون مدنی ایران صورت گرفته و شباهت‌ها و تفاوت‌های آن‌ها مورد بحث قرار می‌گیرد. نتایج این تحقیق نشان می‌دهد که نظریه آیت‌الله بروجردی، با تأکید بر عدالت اجتماعی و مسئولیت‌های مالک، می‌تواند مبنای مناسبی برای اصلاح و بهبود قوانین مالکیت در ایران باشد. در پایان، پیشنهاداتی برای بهبود قوانین مالکیت بر اساس این نظریه ارائه شده و زمینه‌های تحقیقاتی برای مطالعات بیشتر در این زمینه معرفی می‌گردد.</p> https://csjlp.org/index.php/csjlp/article/download/37/20
