Journal Article 1403/04/20 <p>This article examines the role of the democratic nature of the governing system in modern international law. Democracy, as a fundamental principle in human rights and an important criterion for assessing the legitimacy of states and political systems, has always been a key focus in various fields of international law. In this regard, the article aims to analyze the key concepts related to democracy, its historical development in international law, and its relationship with human rights principles, as well as global peace and security. The study first explores different definitions of democracy and its criteria, followed by an analysis of the position of democracy in international documents such as the United Nations Charter and the International Covenant on Civil and Political Rights. The paper then delves into the theoretical foundations of democracy in international law, examining various legal and human rights theories that regard democracy as a crucial standard. Further, the article addresses the practical challenges and critiques related to the acceptance of democracy in international law and analyzes the role of international institutions in promoting and overseeing democracy. onFinally, the article provides a comparative analysis of democratic and non-democratic countries, evaluating successful and unsuccessful examples of implementing democratic criteria in international law. It assesses the challenges and obstacles to achieving democracy at the global level and offers recommendations for improving the current state of affairs. This research aims to provide a more comprehensive understanding of the relationship between democracy and international law and to explore its practical and theoretical implications.</p> <p>مقاله حاضر به بررسی جایگاه معیار دموکراتیک بودن نظام حاکم در حقوق بین‌الملل مدرن می‌پردازد. دموکراسی به‌عنوان یک اصل بنیادین در حقوق بشر و یک شاخص مهم در ارزیابی مشروعیت دولت‌ها و نظام‌های سیاسی، همواره در عرصه‌های مختلف حقوق بین‌الملل مورد توجه قرار داشته است. در این راستا، مقاله تلاش دارد تا مفاهیم کلیدی مرتبط با دموکراسی، تاریخچه و سیر تکاملی آن در حقوق بین‌الملل، و ارتباط آن با اصول حقوق بشر و صلح و امنیت جهانی را تحلیل کند. در این پژوهش، ابتدا تعاریف مختلف دموکراسی و معیارهای آن بررسی می‌شود و جایگاه دموکراسی در اسناد بین‌المللی نظیر منشور سازمان ملل متحد و میثاق‌های بین‌المللی حقوق مدنی و سیاسی تحلیل می‌گردد. سپس به مبانی نظری دموکراسی در حقوق بین‌الملل پرداخته شده و نظریات مختلف حقوقی و حقوق بشری که دموکراسی را به‌عنوان یک معیار در نظر می‌گیرند، مورد واکاوی قرار می‌گیرند. در ادامه، مقاله به بررسی چالش‌های عملی و نقدهای وارد به پذیرش دموکراسی در حقوق بین‌الملل پرداخته و نقش نهادهای بین‌المللی در ترویج و نظارت بر دموکراسی تحلیل می‌شود. در نهایت، مقاله با ارائه تحلیل تطبیقی از کشورهای دموکراتیک و نظام‌های غیردموکراتیک و بررسی تجربیات موفق و ناموفق در پیاده‌سازی معیار دموکراتیک بودن در حقوق بین‌الملل، به ارزیابی چالش‌ها و موانع موجود در راه تحقق دموکراسی در سطح جهانی پرداخته و پیشنهادهایی برای بهبود وضعیت موجود ارائه می‌دهد. این تحقیق به‌طور کلی تلاش دارد تا درک جامع‌تری از رابطه میان دموکراسی و حقوق بین‌الملل ارائه دهد و به بررسی پیامدهای عملی و نظری آن بپردازد.</p> https://csjlp.org/index.php/csjlp/article/download/370/413
