    <Abstract>&lt;p&gt;The occurrence of harm and the commission of a harmful act, as two fundamental elements of civil liability, may result from the omission of ethical and customary duties in Iranian and French law. This issue can have consequences such as civil and even criminal liability, obligating the culpable party to compensate for damages. In French law, severe fault has been established as the criterion for such liability. Instances of the omission of ethical duties in Iranian law can be examined in various domains, including the obligations of physicians towards patients, the responsibilities of contractors, property owners, supervising engineers, and other professionals, the failure to act by sports coaches or lifeguards, the non-fulfillment of duties related to driving responsibilities, and numerous other similar cases. This issue is not confined to the Iranian legal system; rather, it has been considered in comparative studies within Romano-Germanic and common law legal systems as well. One of the main challenges in this field is the lack of precise criteria and standards for identifying and determining liability arising from the omission of ethical and customary duties. Nevertheless, various theories, such as the fault theory, risk theory, mixed theory, and the guarantee of rights theory, have been proposed to justify the acceptance of this type of liability. Iranian law has embraced this form of liability by drawing upon these theories. This study, employing a descriptive and analytical approach, aims to examine civil liability arising from the omission of ethical and customary duties in Iranian and French law. The findings indicate that such liability, in some cases, entails specific obligations such as compensation for damages, and its primary foundation in both Iranian and French law is defined based on the fault theory.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;ورود ضرر و انجام فعل زیان‌بار، به‌عنوان دو رکن اساسی مسئولیت مدنی، می‌توانند از ترک تکالیف اخلاقی و عرفی در حقوق ایران و فرانسه باشند. این موضوع ممکن است تبعاتی همچون مسئولیت مدنی و حتی کیفری به دنبال داشته باشد و شخص مقصر را مکلف به جبران خسارت کند. البته در حقوق فرانسه در راستای اینگونه مسئولیت ها، تقصیر سنگین معیار و ملاک قرار گرفته است. مصادیق ترک تکالیف اخلاقی در حقوق ایران می‌توانند در حوزه‌های متعددی از جمله تعهدات پزشکان در قبال بیماران، وظایف پیمانکاران، مالکان، مهندسین ناظر و دیگر حرفه‌ها، ترک فعل از سوی مربیان ورزشی یا نجات‌غریق‌ها، عدم انجام تکلیف مرتبط با مسئولیت‌های رانندگی و ده‌ها مورد مشابه دیگر مورد مطالعه قرار گیرند. این مسئله تنها به نظام حقوقی ایران محدود نمی‌شود؛ بلکه در مطالعه‌های تطبیقی در نظام‌های حقوقی رومی-ژرمنی و کامن‌لا نیز مورد توجه قرار گرفته است. یکی از چالش‌های اصلی در این حوزه، نبود معیار و ضابطه‌ای دقیق برای شناسایی و تعیین مسئولیت ناشی از ترک تکالیف اخلاقی و عرفی است. با وجود این، نظریه‌های گوناگونی نظیر نظریه تقصیر، نظریه خطر، نظریه مختلط و تضمین حق در راستای پذیرش این نوع مسئولیت ارائه شده‌اند که حقوق ایران با بهره‌گیری از این نظریه‌ها اقدام به پذیرش آن کرده است. این پژوهش، با به‌کارگیری رویکرد توصیفی و تحلیلی، هدف خود را بررسی مسئولیت مدنی ناشی از ترک تکالیف اخلاقی و عرفی در حقوق ایران و فرانسه تعیین کرده است. یافته‌های پژوهش نشان می‌دهند که چنین مسئولیتی در برخی موارد الزامات خاصی همچون جبران خسارت را به همراه دارد و مبنای اصلی آن در حقوق ایران و فرانسه بر پایه نظریه تقصیر تعریف شده است.&lt;/p&gt;</OtherAbstract>
