There is a difference of opinion among jurists regarding the basis of civil responsibility; The range of differences ranges from theories of personal fault to type fault, risk and right guarantee. What is proposed in this article as the basis of civil responsibility is the structure of socialism. Based on this structure, law and ethics have a common and hierarchical origin and both originate from the structure of socialism. In the same way, civil responsibility as one of the branches of law originates from the structure of socialism. Based on this common origin, ethics has a special place in civil responsibility and it is complicated in all its dimensions and they have mutual influence on each other. In this article, the position and role of ethics in civil responsibility has been investigated. مسئولیت مدنی، مسئولیتهای خارج از قرارداد است که به صورت قهری و قانونی ایجاد می شوند. در خصوص مبنای مسئولیت مدنی در میان حقوقدانان اختلاف نظر وجود دارد؛ دامنه اختلافها از نظریات تقصیر شخصی گرفته تا تقصیر نوعی، خطر و تضمین حق را دربرمی گیرد.. آنچه در این مقاله به عنوان مبنای مسولیت مدنی طرح شده ساختار جامعه گرایی است. بر مبنای این ساختار، حقوق و اخلاق خاستگاه مشترک و ذو مراتب دارند و هر دو از ساختار جامعه گرایی نشأت می گیرند. بر همین منوال مسئولیت مدنی نیز به عنوان یکی از شاخه های حقوق از ساختار جامعه گرایی نشأت می گیرد. بر اساس همین خاستگاه مشترک، اخلاق در مسئولیت مدنی جایگاه ویژه ای دارد و در تمامی ابعاد آن پیچیده شده است و در همدیگر تأثیر متقابل دارند. در مقاله حاضر جایگاه و نقش اخلاق در مسئولیت مدنی مورد بررسی قرار گرفته است.
