Journal Article 1404/01/06 <p>The role and position of attorneys in crime prevention within different legal systems—particularly in the criminal law of Iran and the United States—can have a significant impact on reducing crime rates and strengthening the process of fair trial. This article provides a comparative analysis of the role of attorneys in crime prevention in Iran and the United States. Attorneys can contribute to crime reduction through social, situational, and criminal preventive interventions. In the United States, attorneys—by leveraging the media and participating in civil activities—exert considerable influence in critiquing unjust structures, whereas in Iran, despite legislative advancements, certain limitations still exist. By examining this comparison, various recommendations have been proposed to improve and enhance the role of attorneys in crime prevention in Iran, including strengthening legal education for attorneys, establishing legal clinics, and supporting restorative justice programs.</p> <p>نقش و جایگاه وکیل در پیشگیری از جرم در سیستم‌های حقوقی مختلف، به‌ویژه در حقوق کیفری ایران و ایالات متحده آمریکا، می‌تواند تأثیر بسزایی در کاهش جرایم و تقویت فرآیند دادرسی عادلانه داشته باشد. این مقاله به تحلیل تطبیقی نقش وکلا در پیشگیری از جرم در دو کشور ایران و ایالات متحده پرداخته است. وکلا می‌توانند از طریق مداخلات پیشگیرانه اجتماعی، وضعی و کیفری، به کاهش جرم کمک کنند. در ایالات متحده، وکلا با استفاده از رسانه‌ها و مشارکت در فعالیت‌های مدنی، تأثیر زیادی بر نقد ساختارهای ناعادلانه می‌گذارند، در حالی که در ایران، با وجود پیشرفت‌های قانونی، برخی محدودیت‌ها هنوز وجود دارد. با بررسی این تطبیق، پیشنهادات مختلفی برای بهبود و تقویت نقش وکلا در پیشگیری از جرم در ایران ارائه شده است، از جمله تقویت آموزش‌های حقوقی برای وکلا، ایجاد کلینیک‌های حقوقی، و حمایت از برنامه‌های عدالت ترمیمی.</p> https://csjlp.org/index.php/csjlp/article/download/573/328
