<Abstract>
The police caution in England and Wales provides detainees with information regarding the right to silence. Although prior studies conducted with other population groups indicate that this caution is excessively complex for detainees to fully comprehend, this issue had not previously been examined directly among individuals held in police custody. In this study, comprehension of the suspects’ rights warning was assessed across two groups: suspects in a police station (30 individuals) and persons attending a local employment centre in the same area (24 individuals), who were matched in terms of intellectual ability. In both groups, comprehension of the caution was very limited and was not related to their custodial status at the time of testing or to self-reported previous experience with the criminal justice system. Even under optimal testing conditions, only 11% (six participants) demonstrated full understanding of its meaning. The problematic finding is that although more than 96% (fifty-two individuals) claimed to have fully understood the caution after it was delivered in the standard police format, none of them in fact possessed such accurate comprehension. The study concludes with practical recommendations for reducing these issues but underscores the critical need to design a revised and simplified version of the current caution; otherwise, the likelihood of judicial error will remain.
</Abstract>
    <OtherAbstract Language="FA">
</OtherAbstract>
