Alongside its numerous benefits, this transformation has generated new legal challenges, particularly concerning civil liability arising from online activities. The present study examines the various dimensions of such liability within the Iranian legal system and evaluates its strengths and weaknesses. In Iran's legal framework, civil liability is founded upon traditional principles such as the doctrine of causation and the principle of the personal nature of liability. However, these principles face significant challenges when applied to the distinctive characteristics of cyberspace, including user anonymity and the rapid dissemination of information. In particular, in cases involving violations of privacy and the dissemination of false information, the absence of comprehensive legislation results in extensive interpretations of traditional legal rules and, consequently, inconsistent outcomes. This study also examines efforts undertaken to formulate cyberspace-related legislation in Iran, including the “User Rights Protection Plan,” and demonstrates that substantial legal gaps still remain. Ultimately, the research emphasizes the necessity of revising Iranian laws and developing specific regulations governing cyberspace in order to establish a coherent and effective legal framework for protecting individual rights in this environment. Based on the findings, it is recommended that, given the unique characteristics of cyberspace, codified laws be enacted to specifically address civil liability arising from online activities, privacy violations, and the dissemination of false information. Furthermore, the implementation of educational programs for users and online service providers regarding their rights and responsibilities in cyberspace can enhance awareness and strengthen their ability to protect both their own rights and those of others. با گسترش فناوری اطلاعات و ارتباطات، فضای مجازی به بستر اصلی تعاملات اجتماعی، اقتصادی و فرهنگی در جوامع معاصر تبدیل شده است. این تحول به همراه مزایای خود، چالش‌های حقوقی جدیدی را به‌ویژه در زمینه مسئولیت مدنی ناشی از فعالیت‌های آنلاین به وجود آورده است. پژوهش حاضر به بررسی ابعاد مختلف این مسئولیت در نظام حقوقی ایران می‌پردازد و نقاط قوت و ضعف آن را بررسی می‌کند. در نظام حقوقی ایران، مسئولیت مدنی بر اساس اصول سنتی مانند قاعده تسبیب و اصل شخصی بودن مسئولیت استوار است. این اصول در مواجهه با ویژگی‌های خاص فضای مجازی، نظیر ناشناس بودن کاربران و سرعت انتشار اطلاعات، با چالش‌هایی جدی روبه‌رو هستند. به‌ویژه در مواردی مانند نقض حریم خصوصی و انتشار اطلاعات نادرست، فقدان قوانین جامع منجر به تفسیر موسع از قواعد سنتی و نتایج متناقض می‌شود. این پژوهش همچنین به بررسی تلاش‌های انجام شده برای تدوین قوانین مرتبط با فضای مجازی در ایران، از جمله «طرح صیانت از حقوق کاربران»، می‌پردازد و نشان می‌دهد که هنوز خلأهای قانونی قابل توجهی وجود دارد. در نهایت، این تحقیق بر ضرورت بازنگری در قوانین ایران و تدوین مقررات خاص برای فضای مجازی تأکید می‌کند تا نظام حقوقی منسجم و کارآمدی برای حمایت از حقوق افراد در این فضا ایجاد شود. با توجه به نتایج پیشنهاد می‌شود که با توجه به ویژگی‌های خاص فضای مجازی، قوانین مدونی تدوین شود که به‌طور خاص به مسئولیت مدنی ناشی از فعالیت‌های آنلاین، نقض حریم خصوصی و انتشار اطلاعات نادرست بپردازد. ایجاد برنامه‌های آموزشی برای کاربران و ارائه‌دهندگان خدمات آنلاین در زمینه حقوق و مسئولیت‌هایشان در فضای مجازی می‌تواند به افزایش آگاهی و توانمندی آن‌ها در حفاظت از حقوق خود و دیگران کمک کند.
