    <Abstract>&lt;p&gt;Due to their particular physical, psychological, and social circumstances, children require special and effective protection by the State in various areas, including health care, education, justice, social services, and welfare. Accordingly, the State’s preventive and protective measures toward children are not merely ethical in nature; rather, they constitute legally binding obligations, and failure to fulfill such obligations may result in harm and, consequently, give rise to civil or criminal liability claims against the State. Since the civil liability of the State toward children who have suffered harm is recognized as part of the fundamental obligations of States in contemporary legal systems, the present study, employing a theoretical-analytical method and drawing on library-based sources, legislation, international instruments, legal doctrine, and judicial practice, primarily seeks to elucidate the scope of such liability in the protection of children. The findings indicate that States’ obligations in this regard are not limited to compensating for harm after it has occurred; rather, they also encompass policymaking and legislation, the establishment of protective mechanisms, the training and supervision of public officials, coordination among responsible institutions, early identification and intervention, and the adoption of protective measures. Furthermore, compensable harm in this area includes non-pecuniary damage, medical expenses, rehabilitation costs, psychological and social support, and other restorative measures consistent with the best interests of the child. A comparative examination of the issue further confirms that, in contemporary legal systems, the scope of the State’s civil liability toward children is increasingly developing toward a broader interpretation of the State’s preventive, protective, and compensatory measures.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;&lt;strong&gt;چکیده:&lt;/strong&gt; کودکان به سبب وضعیت خاص جسمی، روانی و اجتماعی، نیازمند حمایت‌های ویژه و مؤثر حاکمیت در حوزه‌های مختلف بهداشتی، آموزشی، قضایی، اجتماعی و رفاهی هستند. ازاین‌رو، اقدامات پیشگیرانه و تأمینی دولت در قبال آن‌ها، نه‌تنها واجد جنبه اخلاقی، بلکه دارای ماهیت حقوقی و الزام‌آور بوده و قصور در انجام آن، می‌تواند زمینه‌ساز بروز خسارت و تبعاً طرح دعوای مسؤولیت مدنی یا کیفری علیه دولت‌ها شود. ازآنجاکه مسؤولیت مدنی حاکمیت در قبال کودکان آسیب‌دیده، به‌عنوان بخشی از تعهدات بنیادین دولت‌ها در نظام‌های حقوقی معاصر، امری پذیرفته‌شده است، این پژوهش با روش نظری ـ تحلیلی و با بهره‌گیری از منابع کتابخانه‌ای، قوانین، اسناد بین‌المللی، دکترین حقوقی و رویه‌ی قضایی، بیشتر به تبیین دامنه‌ی این مسؤولیت در حمایت از کودکان پرداخته است. یافته‌ها حاکی از آن است که تعهدات دولت‌ها دراین‌خصوص منحصر به جبران خسارت پس از وقوع آسیب نیست، بلکه شامل مرحله سیاست‌گذاری و قانون‌گذاری، ایجاد سازوکارهای حمایتی، آموزش و نظارت بر مأموران، هماهنگی میان نهادهای متولی، شناسایی و مداخله زودهنگام و اتخاذ تدابیر تأمینی نیز می‌شود. علاوه‌براین، خسارات قابل جبران در این حوزه، خسارات معنوی، هزینه‌های درمان، توان‌بخشی، حمایت‌های روانی و اجتماعی و سایر اقدامات ترمیمی متناسب با منافع عالیه کودک را در بر می‌گیرد. بررسی تطبیقی موضوع نیز مؤید آن است که دامنه مسؤولیت مدنی حاکمیت نسبت به کودکان در نظام‌های حقوقی معاصر به‌سوی تفسیری موسع از اقدامات پیشگیرانه، تأمینی و جبرانی دولت در حال گسترش است.&lt;/p&gt;</OtherAbstract>
