    <Abstract>&lt;p class="BodyStyle" style="text-align: justify; direction: ltr; unicode-bidi: embed;"&gt;&lt;span lang="EN-GB" style="font-size: 9.0pt; line-height: 115%;"&gt;Migration has increasingly become a major field in which penal policy, security, border control, and victim protection intersect. Afghan migrants are particularly exposed to complex forms of vulnerability because of prolonged displacement, precarious residence status, informal employment, and various forms of social exclusion and discrimination. This study aims to analyze the relationship between the criminalization of migration and intersectional victimization among Afghan migrants, with particular emphasis on their lived experiences in Iran and Western societies. The study adopts a qualitative, analytical, and phenomenological approach and examines how migration and penal policies shape migrants’ perceptions of security, justice, policing, residence, employment, and social belonging. The analysis indicates that criminalization can place migrants in a dual position: they may simultaneously become subjects of intensified legal control and victims in need of protection. Precarious legal status, fear of detention or deportation, limited access to formal employment, and distrust of law-enforcement institutions can significantly reduce migrants’ willingness to report victimization and restrict their effective access to justice. The findings further demonstrate that migrant victimization is inherently intersectional. Gender, ethnicity, social class, age, employment conditions, and migration status interact to shape both the intensity and form of vulnerability. The comparison between Iran and Western societies also reveals that, despite important structural differences, the securitization of migration, the increasing overlap between immigration enforcement and policing, and declining institutional trust among migrants constitute recurring patterns. The study concludes that an effective penal policy should preserve legitimate state authority over borders and residence while clearly distinguishing between migrants as offenders and migrants as victims. It should also guarantee safe access to judicial and social protection without creating additional fear of immigration-related consequences.&lt;/span&gt;&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;مهاجرت در دهه‌های اخیر به یکی از مهم‌ترین حوزه‌های تلاقی سیاست کیفری، امنیت، کنترل مرزها و حقوق بزه‌دیدگان تبدیل شده است. در این میان، مهاجران افغانستانی به دلیل استمرار مهاجرت، وضعیت‌های اقامتی ناپایدار، اشتغال غیررسمی و مواجهه با اشکال مختلف طرد و تبعیض، در معرض گونه‌های پیچیده‌ای از آسیب‌پذیری قرار دارند. پژوهش حاضر با هدف تحلیل رابطه میان جرم‌انگاری مهاجرت و بزه‌دیدگی تقاطعی مهاجران افغانستانی و با تأکید بر تجربه زیسته آنان در ایران و جوامع غربی انجام شده است. رویکرد پژوهش کیفی، تحلیلی و پدیدارشناختی است و در آن تلاش شده است نحوه تأثیر سیاست‌های کیفری و مهاجرتی بر ادراک مهاجران از امنیت، عدالت، پلیس، اقامت، اشتغال و تعلق اجتماعی بررسی شود. یافته‌های تحلیلی نشان می‌دهد که جرم‌انگاری مهاجرت می‌تواند مهاجر را به‌طور همزمان در موقعیت موضوع کنترل کیفری و بزه‌دیده نیازمند حمایت قرار دهد. ناپایداری وضعیت اقامتی، ترس از بازداشت یا اخراج، محدودیت در دسترسی به بازار کار رسمی و بی‌اعتمادی به نهادهای انتظامی از مهم‌ترین عواملی هستند که می‌توانند مانع گزارش بزه‌دیدگی و دستیابی مؤثر به عدالت شوند. همچنین، بزه‌دیدگی مهاجران ماهیتی تقاطعی دارد و عواملی مانند جنسیت، قومیت، طبقه اجتماعی، سن، نوع اشتغال و وضعیت اقامت به‌صورت همزمان شدت و شکل آسیب را تعیین می‌کنند. مقایسه ایران و جوامع غربی نیز نشان می‌دهد که با وجود تفاوت‌های ساختاری، امنیتی‌سازی مهاجرت، پیوند میان کنترل مهاجرت و پلیس، و کاهش اعتماد مهاجران به نهادهای رسمی از الگوهای مشترک هستند. در نتیجه، سیاست کیفری مطلوب باید ضمن حفظ الزامات مشروع کنترل مرز و اقامت، میان مهاجر بزه‌دیده و مهاجر متخلف تمایز روشن ایجاد کرده و دسترسی امن و بدون هراس به حمایت‌های قضایی و اجتماعی را تضمین کند.&lt;/p&gt;</OtherAbstract>
