Both the sending and host states, in accordance with international treaties, customs, and agreements, are committed to providing and implementing the necessary and appropriate measures concerning these pilgrims. In the international system, states bear responsibility not only for their own actions but also for the actions of their nationals toward victims or the victims' home country. According to international law regulations, while a state does not bear criminal responsibility, the criminal responsibility of state leaders, particularly in the case of the commission of international crimes, is conceivable. It should be noted that each state is responsible for the actions of its governmental apparatus, i.e., executive, judicial, and legislative bodies, that are contrary to international law. If, due to an act or omission by these bodies, damage or harm is inflicted on foreigners or pilgrims, this results in the state's international responsibility.</p> <p>زائران اماکن مذهبی که برای ادای فریضه دینی و مناسک و مراسم مذهبی به کشوری سفر می کنند، می بایستی از حرمت و احترام ویژه ای برخوردار باشند و هم دولت فرستنده زائران و هم دولت میزبان بر اساس معاهدات بین المللی، عرفی و قراردادی، متعهد به فراهم سازی و بکارگیری اقدامات لازم و شایسته در خصوص زائران هستند. دولتها در نظام بین المللی در مقابل بزه دیده، یا کشور متبوع بزه دیده، نه تنها در قبال اعمال خود که در قبال اعمال اتباع خود نیز مسئول هستند. بر اساس مقررات حقوق بین الملل، دولت فاقد مسئولیت کیفری است اما مسئوليت کيفری سران دولت ها خصوصا در صورت ارتکاب جنایات  بین المللی امکان پذیر بوده است. لازم به ذکر است هر دولتی مسئول اعمال مغایر حقوق بین الملل دستگاه حکومتی خود یعنی ارگان های اجرایی، قضایی و قانونگذاری می باشد. چنانچه در اثر فعل و یا ترک فعلی ارگان های مذکور، لطمه یا خساراتی به بیگانگان یا زائران وارد شود، موجب مسئولیت بین المللی دولت می شود.</p> https://csjlp.org/index.php/csjlp/article/download/89/67
