<p>Banking supervision is an essential prerequisite for financial stability and depositor protection. However, the supervision of state-owned and private banks in Iran is confronted with a dual ownership structure, fragmented regulations, and overlapping institutional jurisdictions, while the legal system has not established a clear structural and functional distinction between these two categories of banks. The present study aimed to conduct a legal and structural pathology of the supervision of state-owned and private banks in Iran from the perspective of public law. The research employed a descriptive-analytical approach, with data collected through library and documentary research and analyzed qualitatively on the basis of legal rules and principles. The findings indicate that, in state-owned banks, budgetary dependence, political intervention, institutional conflicts of interest, and overlapping jurisdictions constitute the principal supervisory deficiencies. In private banks, the major deficiencies include weak risk-based supervision, limited capacity for early intervention, and inadequate depositor protection. The uniform application of prudential standards is also inconsistent with the principle of proportionality. Furthermore, ambiguity in the definition of banking operations, protracted adjudicatory proceedings, the lack of proportionality between violations and sanctions, and the non-publication of decisions have diminished the deterrent effect of enforcement mechanisms. The emergence and proliferation of unauthorized financial institutions likewise result from the interaction between legal gaps and weaknesses in supervisory mechanisms. Reforming the banking supervisory system requires differentiating prudential requirements according to banks’ institutional mandates, separating regulatory functions from the implementation of monetary policy, strengthening institutional independence and transparency, and pursuing a gradual and context-sensitive transition toward risk-based supervision.</p>
