<p>The prohibition of torture constitutes a peremptory norm (jus cogens) of international law and one of the most fundamental principles of human rights law. Nevertheless, the continuing occurrence of torture demonstrates that prohibition alone is insufficient to ensure the effective prevention of this practice. This study aims to elucidate the evolution of the concept of torture prevention and to examine the development of states’ positive obligations under international law by analyzing the role of international instruments and institutions in shaping this approach. Employing a descriptive–analytical method, the study is based on international legal instruments and the practice and jurisprudence of the Committee against Torture, the Subcommittee on Prevention of Torture, the European Court of Human Rights, the Inter-American Court of Human Rights, as well as the complementary role of the International Criminal Court. The findings demonstrate that the concept of torture prevention has evolved beyond the mere obligation to refrain from engaging in acts of torture and now encompasses a range of positive obligations, including the criminalization of torture, the training of public officials, monitoring places of deprivation of liberty, conducting effective investigations, protecting victims, establishing national preventive mechanisms, and ensuring accountability for perpetrators. The prevention of torture in contemporary international law is therefore founded upon the effective implementation of states’ positive obligations, and international responsibility is not limited to the direct commission of torture; a state’s failure to adopt and implement appropriate preventive measures may likewise give rise to international responsibility.</p>
