<p>Criminal procedure governing military offenses in the Iranian legal system possesses distinctive characteristics compared with ordinary criminal proceedings because of its direct connection with order, security, and discipline within the Armed Forces. In Part Eight of the Code of Criminal Procedure, the legislature, through the establishment of the Judicial Organization of the Armed Forces, military prosecutors’ offices and military courts, specialized military judicial officers, and special wartime judicial authorities, has sought to create a specialized mechanism for adjudicating offenses related to specific military and law-enforcement duties. Nevertheless, an examination of these provisions demonstrates that the jurisdiction of military courts under Iranian law is exceptional and limited. The mere fact that the accused is a member of the Armed Forces is not sufficient to bring a case within the jurisdiction of these courts; rather, the offense must be related to the accused’s specific military or law-enforcement duties. Moreover, although the Judicial Organization of the Armed Forces is structurally situated within the Judiciary and its judicial officials possess powers comparable to those of officials within the ordinary judicial system, the particular characteristics of the military environment—including the chain of command, confidentiality requirements, the need for expeditious proceedings, and the extensive role of military judicial officers—may, in practice, create challenges for judicial independence and the accused’s rights of defense. The findings of this study indicate that the principal issue in Iranian military criminal proceedings is not the existence of a specialized judicial authority per se, but rather the manner in which its jurisdiction and procedures are regulated and implemented in light of the principles of a fair trial. Accordingly, ensuring access to legal counsel familiar with the military environment—including legal representatives of the Armed Forces who, pursuant to Article 8(d) of the Bill on the Independence of the Iranian Bar Association, are permitted to practice law after retirement—limiting the jurisdiction of military courts, establishing effective oversight of military judicial officers, guaranteeing the right of access to legal counsel, and clearly defining exceptional circumstances constitute some of the most important reform measures in this field.</p>
