Abstract

This study was conducted with the aim of examining the nature and instances of criminal fault in Iranian law. The research method was descriptive-analytical, utilizing books, articles, dissertations, and other academic sources. A review of existing studies revealed that the term “criminal fault” has not been explicitly used in the language of Iranian criminal statutes, and it is only within legal doctrine that criminal negligence has been regarded as synonymous with criminal fault. Criminal fault is a recognized subject in criminal law and refers to behavior characterized by carelessness, recklessness, negligence, and inadvertence, the consequence of which is the imposition of criminal punishment on the perpetrator. It is mostly associated with unintentional crimes, although it is possible to discuss a form of intentional criminal fault in the context of intentional offenses as well. Accordingly, this study presents the nature and instances of criminal negligence, along with its scope and boundaries, as well as criminal liability resulting from fault and omission.
