The Nature and Examples of Criminal Error in Iranian Law

Abstract

This research was conducted with the aim of investigating the nature and examples of criminal error in Iranian law. The research method was descriptive and analytical using books, articles, theses, etc. The research study showed that "criminal error" is not used in the literature of Iranian criminal laws and only the doctrine considers criminal fault as synonymous with criminal error. A criminal offense is one of the issues raised in criminal law and it is a behavior based on carelessness, recklessness, neglect and negligence, the result of which is the punishment of the perpetrator, and it can be imagined mostly in unintentional crimes, although in intentional crimes, it can also be a type of error. Therefore, in this research, while stating the nature and examples of culpability, the territory and scope along with the criminal liability in culpability and negligence were also presented
