Traditional Electoral Violations and Their Impact on Electoral Integrity

Elections are the primary means through which the will of the people is expressed and democratic legitimacy is strengthened. However, their integrity is often undermined by traditional electoral violations. This study examines these violations within a comparative legal framework and focuses on their impact on electoral integrity through three principal forms: vote buying, misuse of public funds and state resources, and interference with the freedom of candidacy and electoral campaigning. The study demonstrates that such practices violate freedom of voting, equality of opportunity, and political equality, while simultaneously undermining public trust in the electoral process. It concludes that electoral integrity requires a comprehensive legal framework, effective judicial protection, transparency in campaign financing, and the impartiality of administrative and media institutions in order to safeguard the public will and strengthen democratic legitimacy.
