The Appropriate Legal System for the Real Estate Registration Organization in Iran with an Emphasis on Cadastre
Abstract
In today's world, the management of urban lands and the establishment of justice in maintaining and preserving parcel boundaries require a comprehensive system. This system should not only enable the registration of detailed characteristics of households and parcels but also assist in the intelligent analysis of urban space and the integration and correlation of urban elements and components. The fundamental question in this regard is to what extent the current cadastral registration system of real estate in the country's executive apparatus aligns with the upstream documents. The present study is descriptive-analytical and employs a library research method to address the aforementioned question. The findings indicate that cadastre, as a land-based information system, plays a decisive role in real estate planning. The most critical component of descriptive information related to real estate is the legal information, which clearly defines the legal and ownership dimensions of properties. Registration maps or cadastre consist of systematically regulated datasets of information about real estate and immovable assets in each country or region, with maps forming their foundation. These maps reflect property boundaries. The primary objectives of utilizing this system include creating a better foundation for tax collection, land registration, and providing an appropriate method for improved land use control and management.
