Abstract

This study aims to examine the nature of negligent criminal liability in the legal systems of Iran and England. The research method is descriptive-analytical, utilizing library resources and information databases. The findings of this research indicate that while both legal systems acknowledge the importance of negligent criminal liability, there are significant differences in how it is defined and enforced. These differences can have profound implications for criminal justice and the approach to addressing harm caused by negligence. The study's findings reveal that Iranian and English criminal law share many similarities concerning negligent liability, particularly the offense of recklessness. The legislators' perspectives in both legal systems are relatively close, although some differences are observed.
