The Impact of Artificial Intelligence on the International Responsibility of States

Abstract

The rapid expansion of artificial intelligence within governmental, security, economic, judicial, and social structures has fundamentally challenged the traditional framework of the international responsibility of states. This study aims to examine the impact of artificial intelligence on the core elements of state responsibility, particularly attribution, breach of international obligations, and reparation. The research adopts a descriptive-analytical approach based on international legal sources and contemporary scholarship on artificial intelligence. The findings indicate that although AI systems possess varying degrees of autonomy and independent decision-making capacity, such characteristics cannot serve as a basis for eliminating state responsibility. States remain accountable for the design, deployment, supervision, regulation, and consequences of intelligent systems, especially when these technologies are used in areas such as security, healthcare, judicial processes, taxation, trade, and public surveillance. Moreover, the use of artificial intelligence may contribute to human rights violations, algorithmic discrimination, breaches of privacy, restrictions on fundamental freedoms, and difficulties in compensating transboundary harms. The study concludes that while the traditional rules of international responsibility remain applicable, they require reinterpretation and further development in order to address the complexities created by autonomous technologies. Accordingly, the development of international standards concerning algorithmic transparency, meaningful human oversight, state accountability, and risk assessment of AI systems appears necessary for ensuring effective legal governance in the digital age.
