Abstract

Good marital conduct is regarded as one of the most fundamental concepts in the legal and jurisprudential framework of the family and plays a decisive role in either strengthening or destabilizing marital relations. This concept is not limited merely to refraining from violence or abuse; rather, it also encompasses behavioral, verbal, emotional, and economic dimensions. Imami jurisprudence, particularly in the views of contemporary jurists, considers good marital conduct to be both an ethical and a religious obligation and emphasizes dignified treatment, mutual respect, tolerance, fidelity, and observance of the spouse’s human rights. In contrast, Iranian positive law, while recognizing the principle of good marital conduct under Article 1103 of the Civil Code, places greater emphasis on its legally binding and judicial dimensions; however, it remains ambiguous regarding the identification of its practical instances and the provision of clear enforcement mechanisms. Adopting a descriptive-analytical approach and drawing on jurisprudential and legal sources as well as contemporary scholarly perspectives, this article elucidates the concept of good marital conduct and its manifestations and demonstrates that integrating jurisprudential and legal perspectives can enhance the effectiveness of the family legal system and strengthen marital relationships. Finally, after critically examining existing legislative and enforcement deficiencies, the article proposes measures for clarifying the manifestations of good marital conduct, strengthening premarital education, and undertaking legislative reform.
