بررسی ماهیت مسئولیت کیفری مسامحهای در دو نظام حقوقی ایران و انگلیس

این پژوهش با هدف بررسی ماهیت مسئولیت کیفری مسامحهای در دو نظام حقوقی ایران و انگلیس انجام شد. روش تحقیق توصیفی – تحلیلی با استفاده از منابع کتابخانهای و بانک های اطلاعاتی بود. نتایج این تحقیق نشان میدهد که در حالی که هر دو نظام حقوقی به اهمیت مسئولیت کیفری مسامحهای اذعان دارند، تفاوتهای قابل توجهی در نحوه تعریف و اجرای آن وجود دارد. این تفاوتها میتواند تأثیرات عمیقی بر روی عدالت کیفری و نحوه پاسخگویی به آسیبهای ناشی از سهلانگاری داشته باشد. یافته های پژوهش گویای آن است که حقوق کیفری ایران و انگلیس در باب مسوولیت مسامحهای خاصه جرم بیاحتیاطی (بی پروایی) شباهت های بسیاری دارند و نگرش مقنن در هر دو نظام حقوقی به یکدیگر نزدیک است هر چند تفاوت هایی هم دیده میشود.
