تاثیر هوش مصنوعی بر مسئولیت بین‌المللی دولت‌ها

چکیده

گسترش سریع فناوری هوش مصنوعی در ساختارهای حکمرانی، امنیتی، اقتصادی، قضایی و اجتماعی، نظام سنتی مسئولیت بین‌المللی دولت‌ها را با چالش‌های بنیادین مواجه ساخته است. هدف این پژوهش، تحلیل تأثیر هوش مصنوعی بر ارکان مسئولیت بین‌المللی دولت‌ها، به‌ویژه مسئله انتساب، نقض تعهدات بین‌المللی و جبران خسارت است. پژوهش حاضر با روش توصیفی ـ تحلیلی و با تکیه بر منابع حقوق بین‌الملل و مطالعات نوین مرتبط با هوش مصنوعی انجام شده است. یافته‌ها نشان می‌دهد که هرچند سامانه‌های هوش مصنوعی از سطحی از خودمختاری و تصمیم‌گیری مستقل برخوردارند، اما این ویژگی نمی‌تواند مبنایی برای رفع مسئولیت دولت‌ها باشد. دولت‌ها همچنان در قبال طراحی، استفاده، نظارت، تنظیم‌گری و پیامدهای ناشی از سامانه‌های هوشمند مسئولیت دارند، به‌ویژه زمانی که این سامانه‌ها در حوزه‌هایی چون امنیت، سلامت، قضاوت، مالیات، تجارت و نظارت عمومی مورد استفاده قرار می‌گیرند. همچنین، استفاده از هوش مصنوعی می‌تواند زمینه‌ساز نقض حقوق بشر، تبعیض الگوریتمی، نقض حریم خصوصی، محدودسازی آزادی‌های بنیادین و دشواری در جبران خسارت‌های فرامرزی شود. پژوهش نتیجه می‌گیرد که قواعد سنتی مسئولیت بین‌المللی، اگرچه همچنان قابلیت اعمال دارند، اما برای مواجهه با پیچیدگی‌های فناوری‌های خودمختار نیازمند بازتفسیر و تکمیل هستند. بر این اساس، توسعه استانداردهای بین‌المللی در حوزه شفافیت الگوریتمی، نظارت انسانی، پاسخگویی دولت‌ها و ارزیابی ریسک سامانه‌های هوش مصنوعی ضروری به نظر می‌رسد.
