جایگاه پیشگیری در شریعت اسلامی و بازتاب آن در قوانین کیفری افغانستان

پژوهش حاضر با هدف تبیین جایگاه پیشگیری در شریعت اسلامی و بازتاب آن در قوانین کیفری افغانستان، با تأکید بر تحولات تقنینی دورهی امارت اسلامی، انجام شده است. مفهوم پیشگیری به مجموعه اقدامات قانونی، نظارتی و اجرایی اطلاق میشود که با هدف شناسایی، ارزیابی و خنثیسازی تهدیدات پیش از وقوع جرم صورت میگیرد. این پژوهش با روش توصیفی-تحلیلی و با بهرهگیری از منابع کتابخانهای و اسنادی، به بررسی مبانی فقهی این مفهوم در شریعت اسلامی با تأکید بر قواعدی مانند دفع ضرر محتمل، قاعدهی لاضرر، و نهادهای حسبه و امر به معروف و نهی از منکر، و نیز بازتاب آن در قوانین موضوعهی افغانستان در دو دورهی پیشین (قانون جزای ۱۳۵۵ و اصلاحیه ۱۳۹۶) و کنونی (اصولنامهی جزایی و قوانین نافذ امارت اسلامی) پرداخته است. یافتهها نشان میدهد که شریعت اسلامی ظرفیتهای غنی و نظاممندی برای پیشگیری از جرم فراهم کرده است و نظام حقوقی افغانستان در هر دو دوره، با الهام از این آموزهها، نهادهای ارزشمندی را شناسایی کرده است. با این حال، تحول ساختاری نظام حقوقی از قانونگذاری پارلمانی به نظام شرعی-اداری در دورهی امارت اسلامی، هم ظرفیتهای جدیدی برای نهادینهسازی رویکردهای پیشگیرانه مبتنی بر فقه حنفی ایجاد کرده و هم چالشهای تازهای در زمینهی توازن میان شریعت، قوانین موضوعه و حقوق شهروندی مطرح ساخته است. نتیجهگیری پژوهش نشان میدهد که تحقق پیشگیری پایدار و مشروع در افغانستان، نیازمند توجه به زمینههای تکامل از جمله ایجاد انسجام بیشتر در چارچوب تقنینی، تدوین معیارهای عینی برای تشخیص مفاهیم کلیدی شرعی، و استقرار نظام نظارت قضایی مؤثر بر اقدامات پیشگیرانه است که با تکیه بر ظرفیتهای فقه حنفی و با مشارکت نهادهای دینی، محلی و …، امکانپذیر خواهد بود.
