Examination of the Foundations of Civil Liability of Arbitrators in Iranian Law and International Trade

The present study examines the fact that parties often resort to arbitration, both in domestic and international disputes, with the aim of achieving a more efficient dispute resolution process compared to litigation in courts. Arbitration is considered advantageous due to its relatively faster procedure, lower costs, confidentiality of hearings, and non-formal nature. Furthermore, the arbitration process allows the parties greater influence and flexibility than judicial proceedings. In the selection of arbitrators, attributes such as reliability and expertise in the subject matter of the dispute have strengthened the preference for arbitration over recourse to the judicial system. This has significantly enhanced the position of arbitration in the settlement of both domestic and international disputes. Given the importance of this issue, the present article—using a descriptive-analytical approach and a library-based research method—seeks to examine the foundations of civil liability of arbitrators under Iranian law and international trade law.
