Abstract

Online arbitration, as one of the important innovations in the field of dispute resolution, has gained increasing importance with the expansion of e-commerce and the globalization of the economy. This method, which enables the conduct of arbitration processes offline by utilizing digital technologies, has several advantages, including cost reduction, time savings, and global access. However, the enforcement of online arbitration awards faces several legal and regulatory challenges.

Key challenges include the lack of coordination between national and international laws, issues related to the recognition of jurisdiction, and problems related to the recognition and enforcement of cross-border awards. In addition, the lack of appropriate technological infrastructure, concerns about information security, and ensuring fairness and impartiality in online arbitration processes are other obstacles.

By analyzing these challenges and providing suggested solutions, this article emphasizes the importance of updating national laws, developing global standards, and developing technological infrastructure. It also examines the role of education and awareness-raising in increasing public trust in online arbitration. The results show that addressing these challenges through international cooperation and reforming existing legal frameworks can lead to improved performance and expanded use of online arbitration as an efficient and fair tool for resolving disputes.
