Strategies for popularizing the judicial system to reduce crimes in light of the judicial transformation program

Abstract

Popularizing the judicial system is one of the important issues in the legal and political system of the Islamic Republic of Iran, and this study has addressed its role in reducing crimes. The question is, what are the most important strategies for popularizing the judicial system in order to reduce crimes from the perspective of the judicial transformation program? The results have shown that the principles of the Constitution, including the principle of the rights of the nation in Chapter Three of the Constitution, Article 26 of the Constitution with support for the formation of guilds and associations, Article 168 of the Constitution with support for litigation, and Article 90 of the Constitution with support for the people to address the situation of the three branches of government, as well as specifically, the guidelines for the participation and interaction of popular institutions with the judiciary, announced on 12/6/1398, and the document on the transformation and excellence of the judiciary announced on 2/8/1403, play an important role in popularizing the judiciary in various ways. However, to improve conditions and operationalize the popularization of the judicial system, it is necessary to develop communication channels via telephone, social networks, and public meetings at the provincial and city levels through direct dialogue between judicial authorities, including provincial and city courts, and the general public. In addition, supporting the independence of non-governmental judicial institutions such as bar associations and institutions supporting the release of prisoners and the fight against corruption play an important role in reducing crimes. At the sentencing stage, supporting the approaches of alternative social punishments and release of prisoners proposed by non-governmental judicial institutions such as public peace and reconciliation institutions to deal with long-term imprisonment and unintentional crimes and retribution are examples of the popularization of the judicial system. The present article uses a descriptive and analytical method and library tools.
