Fair trial is one of the fundamental components of the criminal justice system and plays a decisive role in determining the legitimacy of judicial decisions and the extent to which individual rights are protected throughout criminal proceedings. This concept is not limited to safeguarding the rights of the accused; rather, it also encompasses the protection of victims, their effective participation in proceedings, access to justice, judicial protection, and the possibility of obtaining compensation for harm suffered. The present study aims to identify and explain the manifestations of fair trial for victims and offenders in judicial decisions and to examine how a balance can be established between the rights of these two parties within criminal proceedings. The study adopts a descriptive-analytical method and examines the fundamental principles and guarantees of fair trial in relation to both accused persons and victims, as well as their reflection in judicial reasoning. The findings indicate that the presumption of innocence, the right to defense, access to legal counsel, the right to remain silent, legality of proceedings, judicial impartiality, reasoned judgments, and access to appeal constitute the principal manifestations of fair trial for the accused. By contrast, access to justice, the right to be heard, the opportunity to submit evidence, protection of security and dignity, prevention of secondary victimization, and access to compensation mechanisms represent the principal manifestations of fair trial for victims. Judicial decisions are most consistent with fair-trial standards when courts independently and carefully assess the evidence, respond to the arguments and claims of both parties, and maintain an appropriate balance among criminal responsibility, victims’ rights, and legal requirements. Ultimately, the realization of fair trial requires moving beyond one-sided approaches toward a balanced, law-based, and human-dignity-centered model of criminal adjudication.
