Abstract

Global warming is one of the world's environmental challenges, accelerating climate change due to carbon dioxide emissions. This phenomenon has led to issues such as drought, forest fires, and floods, threatening the survival of millions of humans, plants, and animal species. Another critical environmental challenge is water scarcity. This vital resource for the survival of humans, animals, and plants affects more than 40% of the global population. Reviving the environment and restoring the Earth’s vitality plays a crucial role in fostering hope and joy among people. In this context, the importance and status of the environment must not be overlooked. International law, whose primary objective is establishing international order through peace, security, and cooperation among states, has seen significant developments in recent decades regarding environmental issues. Scientific advancements and the creation of modern technologies have led to more serious discussions and examinations of environmental protection. The International Court of Justice (ICJ), as the principal judicial organ of the United Nations, plays a vital role in protecting the environment and developing international environmental law. States also have important obligations and responsibilities for environmental protection and the advancement of international environmental law. States must safeguard the environment from pollution, degradation, and other threats, and refrain from posing any threats to the environment of other nations. Within this framework, constructive cooperation and interaction between the ICJ and states in the form of environmental diplomacy and adherence to international obligations can play a significant role in protecting the environment and enhancing international environmental law.
