Strategies for Reducing Trial Delays in the Criminal Policy of the Islamic Republic of Iran with Emphasis on Judicial Management

Abstract

The problem of trial delays in judicial courts causes numerous detrimental consequences for actors in the judicial field, including litigants, prosecutors, court judges, as well as other staff members and executive managers of the Judiciary. One of these consequences is the disruption of the Judiciary’s performance in achieving the objective of fair and equitable adjudication. This issue becomes particularly significant in the criminal justice system. The primary aim of this study is to identify strategies for reducing trial delays through an examination of factors influencing judicial management. Conducted using library resources and an analytical–descriptive method, the study found that measures taken by the Judiciary to develop and enhance the performance of electronic systems constitute one of the most influential factors among other determinants of judicial management, leading to a reduction in trial delays in Iran’s criminal policy. Furthermore, the use of such systems, by increasing transparency in the Judiciary’s performance and enabling continuous public oversight, further facilitates the realization of judicial justice through the rule of law.
