مسئولیت مدنی ناشی از طراحی، تولید و عرضه هوش مصنوعی

چکیده

گسترش روزافزون هوش مصنوعی و نفوذ آن در حوزه‌های پزشکی، مالی، تجاری، صنعتی و خدماتی، در کنار مزایای گسترده، چالش‌های تازه‌ای در زمینه مسئولیت مدنی ایجاد کرده است. پیچیدگی الگوریتم‌ها، استقلال نسبی سامانه‌های هوشمند، قابلیت یادگیری و تغییر رفتار، تعدد بازیگران دخیل در چرخه حیات فناوری و دشواری شناسایی علت مستقیم زیان، سبب شده است که قواعد سنتی مسئولیت مدنی در برخی موارد با محدودیت مواجه شوند. پژوهش حاضر با هدف تحلیل مسئولیت مدنی ناشی از طراحی، تولید و عرضه هوش مصنوعی و تعیین مبانی مناسب برای انتساب خسارت به بازیگران مختلف این حوزه انجام شده است. روش پژوهش توصیفی ـ تحلیلی و مبتنی بر بررسی قواعد عمومی مسئولیت مدنی و ویژگی‌های خاص سامانه‌های هوش مصنوعی است. یافته‌ها نشان می‌دهد که مسئولیت طراح می‌تواند در مواردی مانند انتخاب معماری نامناسب، استفاده از الگوریتم غیرایمن، فقدان سازوکارهای کنترلی و پیش‌بینی‌نکردن خطرهای قابل انتظار تحقق یابد. مسئولیت تولیدکننده نیز می‌تواند ناشی از استفاده از داده‌های نامعتبر یا جانبدارانه، آزمون ناکافی، ضعف امنیت سایبری، خطا در پیاده‌سازی یا کوتاهی در به‌روزرسانی و کنترل کیفیت باشد. در مرحله عرضه، عدم ارائه اطلاعات کافی، هشدار ناقص، تبلیغات گمراه‌کننده، عرضه سامانه برای کاربرد نامتناسب و قصور در نظارت پس از عرضه می‌تواند مبنای مسئولیت قرار گیرد. نتایج همچنین نشان می‌دهد که در سامانه‌های هوش مصنوعی پرخطر، اتکای صرف بر مسئولیت مبتنی بر تقصیر ممکن است برای حمایت از زیان‌دیدگان کافی نباشد. بنابراین، استفاده از رویکردی مبتنی بر سطح خطر، تسهیل بار اثبات، مسئولیت مبتنی بر خطر و بیمه اجباری در برخی کاربردها ضروری به نظر می‌رسد. تدوین چارچوبی ویژه برای توزیع مسئولیت میان طراح، تولیدکننده، عرضه‌کننده و کاربر می‌تواند ضمن حمایت از زیان‌دیدگان، زمینه توسعه مسئولانه هوش مصنوعی را نیز فراهم سازد.
